JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This application, for grant of anticipatory bail, arises out of Banka P.S. Case No. 369/2019, disclosing offences under Sections 379 and 411 of the Indian Penal Code. Allegation as per F.I.R. is that four miscreants were breaking open the lock of Gumti of the informant and on seeing the informant coming, they started fleeing away, however, one of them was caught by the informant, who disclosed the names of petitioner and others as the persons, who fled away. Submission of learned counsel for the petitioner is that he has falsely been made accused in this case only on the basis of disclosure made by the co-accused and except that there is nothing against the petitioner and he has no criminal antecedent.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka P.S. Case No. 369/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
