This application is for grant of regular bail in connection with Jhajha P.S.Case No.115 of 2018 dated 24.3.2018 for the offences under Sections 121, 121(A), 120(b) of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act and Sections 3/4 of the Explosive Substance Act and under Sections 16, 17, 18, 19, 20, 21, 22 of UAP Act.
On information that nexalites have been noticed, the police started checking and one motorcycle was recovered and the petitioner was arrested and from the motorcycle steel cane filled with expulsive substance and one detonator, electric wire and 12 bore cartridges. The petitioner has criminal antecedent also. Submission of the learned counsel for the petitioner
Patna High Court Cr.Misc. No.47857 of 2018 (2) dt.27-09-2018 2/2 is that nothing has been recovered and moreover the petitioner is in custody since 24.3.2018.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, once the charge is framed in this case and trial commenced, the learned trial court shall release the petitioner on bail in connection with Jhajha P.S.case No.115 of 2018 dated 24.3.2018 to his own satisfaction. With the aforesaid observation, this application is disposed of.
