The Letters Patent Appeal was disposed of by a coordinate Bench of this Court with a direction to the respondents to verify the period the petitioner has worked and to pay her salary in accordance with law. Since, the order was not complied with within the prescribed time, this contempt application has been filed.
Patna High Court MJC No.3543 of 2017 dt.10-09-2018 2/3 Today, a show cause has been filed on behalf of the District Programme Officer enclosing the letter dated 01.09.2018 addressed to the Branch Manager, Punjab National Bank, Lakhisarai whereby an amount of Rs. 1,38,724=00, stated to be the arrears of salary of the petitioner for the period November, 2014 until 12.02.2016, has been transferred.
Mr. Shashi Shekhar Tiwari, learned Assistant Counsel to AAG-15 makes reference to the statement of account of the petitioner enclosed with the show cause and informs that while this amount was credited in the account of the petitioner on 04.09.2018, on the same day she has withdrawn the amount. It is surprising that even when the relief has reached the petitioner, she has not bothered to inform her counsel until today, despite the pending contempt application.
A payer for adjournment is being made by the learned counsel for the petitioner to verify the position but we are not persuaded to grant adjournment considering that the statement made in the show cause is based on records.
We accordingly, proceed to dispose of the contempt proceeding with liberty to the petitioner to raise her grievance before the appropriate authority, in case, she is not satisfied with the quantification of her arrears.
