2. The petitioner seeks bail in connection with Punaura P.S. Case No. 142 of 2025 registered for the offence under Sections 126(2), 115(2), 117(2), 109, 352, 351(2), 3(5) of BNS and u/s 27 of Arms Act.
3. The petitioner is named in the F.I.R. and is in custody since 07.07.2025.
4. As per FIR, petitioner alongwith other co-accused person assaulted informant, where during course of occurrence one accused namely, Heera Paswan, opened firing causing fire arm injury to one Asjad Reza and Nashad Raza. Informant also alleged to receive injury during the
Patna High Court CR. MISC. No.67727 of 2025(4) dt.01-12-2025 2/3 occurrence.

Learned counsel appearing on behalf of the petitioner submitted that the present occurrence took place due to neighborhood dispute and differences between the parties where the allegation against petitioner qua physical assault is appearing very much general and omnibus. It is submitted that even allegation regarding causing fracture in hand is specifically available against Raushan Kumar and, moreover, upon medical examination the injury of informant found simple in nature which is annexure-2 of present bail petition. It is also submitted that the allegation of firing is also not available against this petitioner, rather same is available against Heera Paswan. While concluding the argument, it is submitted that petitioner is found involved in one more criminal case where he is on bail and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

7. In view of aforesaid factual submission and by

No.67727 of 2025(4) dt.01-12-2025 3/3 taking note of nature of allegation qua physical assault which appears very much general and omnibus against petitioner as discussed aforesaid, coupled with fact that investigation of this case already completed where petitioner remains in custody since 07.07.2025, accordingly petitioner above named, is directed to be released on bail in connection with Punaura P.S. Case No. 142 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi /concerned court, subject to the conditions as mentioned under Section 480(3) of BNSS.
