2. The petitioner is apprehending her arrest in connection with Tariyani P.S. Case No. 155/2025 registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 74, 109, 132, 303(2), 352, 324(4) of BNS Act.

As per prosecution case, informant received secret information that co-accused Shashi Ranjan Rai and his brother Madhurendra Rai have stored illicit liquor in their house and involved in the illegal trade of liquor. It is alleged that when the informant along with raiding team entered into the house of coaccused Shashi Ranjan Rai, his mother namely Rinku Devi pretended to become unconscious and started flopping at the
Patna High Court CR. MISC. No.69397 of 2025(2) dt.08-10-2025 2/3 verandah. It is further alleged that co-accused Puja Kumari and petitioner caught hold collar of a lady police officer of raiding team and started assaulting her.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged in the FIR and she has falsely been implicated in this case. Petitioner being a lady having no criminal antecedent. The counsel for the petitioner submits that only allegation against petitioner is that she along with co-accused Puja Kumari is said to have misbehaved and assaulted the lady police officer but name of said lady police officer has not been mentioned in the FIR which questions the authenticity of prosecution story. He further submits that the allegation against the petitioner is general and omnibus in nature. He further submits that due to highhandedness of police, petitioner and her family members have been falsely implicated in the present case.
5. The learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that petitioner misbehaved and assaulted the lady police officer as same is evident from the FIR itself. Hence, petitioner does not deserve anticipatory bail.
6. Considering the facts and circumstances of the case,

No.69397 of 2025(2) dt.08-10-2025 3/3 petitioner being a lady having no criminal antecedent, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sheohar in connection with Tariyani P.S. Case No. 155/2025, subject to the conditions as laid down under Section 482(2) of B.N.S.S.
7. The application stands allowed.
