Petitioner is in custody in connection with Warisnagar P.S. case No. 241 of 2017 for the offence under section 394 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the case was registered against unknown and after five months of the occurrence at the disposal of the co-accused, search was made in the house of the petitioner and police seized three mobiles belonging to the petitioner.
Learned counsel for the petitioner submits that the EMI number of the mobiles of the petitioner is distinct from the looted mobile and as such the petitioner deserves bail. Considering the fact that the petitioner is in custody since
Patna High Court Cr.Misc. No.36302 of 2018(3) dt.24-07-2018 2/2 13.2.2018 and he was not put on TIP in a case against unknown, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Samastipur, in connection with Warisnagar P.S. Case No. 241 of 2017.
