2. The petitioner seeks regular bail in a case registered for the offence under Sections 302, 120(B) of the Indian Penal Code.

3. As per the prosecution case, the dead body of the deceased was recovered. Subsequently during investigation it has come that the petitioner was found riding the motorcycle with the deceased and thereafter the deceased was killed.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He is in jail since 30.08.2022.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.72671 of 2023(2) dt.09-11-2023 2/2 prayer for bail.

6. Considering the fact that petitioner is involved in killing of the deceased, I am not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed.

8. The Court below is directed to expedite the trial of the petitioner.
