2. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 45 of the Bihar Prohibition& Excise Amendment Act.

3. The case of the prosecution is that 9.200 liters Codeine Phosphates Triprolidine Hyorochloride cough syrup was recovered from possession of co-accused Jitu Kumar.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has surfaced on the basis of confessional statement of apprehended co-accused ,Jitu Kumar. It has been submitted that from perusal of the FIR as well as seizure list it appears that nothing has been recovered from

Patna High Court CR. MISC. No.70073 of 2025(2) dt.07-10-2025 2/2 possession of the petitioner. The petitioner is in custody since 23.08.2025 having criminal antecedent of one case in which he is on bail.

5. The learned APP for the State vehemently opposes the prayer for bail of the petitioner.

6. Considering the fact and circumstances of the case and submissions of the parties, let the above named petitioner, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge- VII cum Special Judge, Excise -II Madhepura in connection with Madhepura Excise P.S. Case No. 191 of 2025 with a condition that the petitioner shall not indulge himself in similar nature of offence in future.
