Petitioner apprehends arrest in connection with Biraul P.S. Case No.; 62 of 2017 registered for the offence punishable under sections 30(a), 38(i) and 41(i) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case on basis of confessional statement of the co-accused. Nothing has been recovered from the conscious possession of with this petitioner. Petitioner has no concern either with the alleged illicit liquor or with the seized motorcycle. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.63198 of 2019(2) dt.18-10-2019 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II-cum-Special Judge, Excise Act, Darbhanga in connection with Biraul P.S. Case No. 22 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
