2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 341, 323, 307, 504 and 379 of the Indian Penal Code

3. Allegation against the petitioner along with other co-accused persons is that the petitioner along with others started abusing the informant. It is further alleged that the petitioner assaulted the informant with an iron rod, due to which he sustained injury.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that there is also a counterblast of this case and that the trial court

Patna High Court CR. MISC. No.72344 of 2024(2) dt.07-10-2024 2/2 has mentioned that the nature of injury sustained is simple. He has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 14.07.2024.

5. Learned APP appearing for the state has vehemently opposed the prayer of regular bail. He has also admitted that there is case and counter case from the perusal of the FIR. It is also clear that there is allegation of one blow and the nature of injury is simple.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Neemchak Bathani P.S. Case No. 37 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gaya.
