ANJANA MISHRA ORAL ORDER 24-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 25.04.2018 in connection with Ghorasahan (Lakhaura) P.S. Case No. 263/2014 registered for the offences punishable under Sections 147/149/342/323/448/379/506/504/457/380 of the Indian Penal Code.

Learned counsel for the petitioner submits that general and omnibus allegation has been made against the 13 named accused persons which also includes the petitioner. It is further submitted that the petitioner was a part of the crowd which had come to her house and had intimidated her and looted household articles to the tune of Rs. 1.5 Lakh is also false and mischievous and so far as the petitioner is concerned, he has

Patna High Court Cr.Misc. No.48168 of 2018 (2) dt.24-08-2018 2/2 nothing to do with the earlier case filed against some accused persons as the petitioner has a clean antecedent. It is further submitted that no incriminating article has been recovered from the house of the petitioner nor has he been placed on T.I.P. It is further submitted that similarly situated co-accused have since been extended the privilege of bail in Cr. Misc. No. 7102 of 2017 vide order dated 20.02.2017 and also vide order dated 18.03.2017 passed in Cr. Misc. No. 10366 of 2017.

Considering the aforementioned facts and circumstances and only general and omnibus allegation has been levelled against the petitioner and that he has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub divisional Judicial Magistrate, Sikrahna at Dhaka, East Champaran, in connection with Ghorasahan (Lakhaura) P.S. Case No. 263/2014.
