The petitioner in this case is seeking anticipatory bail in connection with Purnea Sadar P.S. Case No.589 of 2017 registered for the offences punishable under Sections 406, 420 and 379/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that the petitioner has no concern with the alleged occurrence.

Learned APP for the State is present and has opposed the prayer for anticipatory bail of the petitioner. Considering the facts and circumstances of the case that the petitioner is owner and driver of the truck in question on

Patna High Court CR. MISC. No.63829 of 2019(3) dt.06-12-2019 2/2 which the maize was loaded valued at Rs.354017/- and the said maize has been allegedly sold somewhere, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. This application is dismissed.

In case, the petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular bail shall be considered on its own merit without being prejudiced by the order of this Court. (Rajeev Ranjan Prasad, J) arvind/- U T
