The petitioner seeks regular bail in connection with Rani Talab P.S. Case No.59 of 2018 registered for the offences punishable under Sections 420, 467, 468, 471 of the Indian Penal Code and Sections 3, 6 and 8 of Bihar Mineral Prohibition Illegal Transportation Act, 2005 and Section 4/40 of Bihar Mines and Minerals Concession Rule.

The allegation against the petitioner is that he was caught by the informant while the petitioner was carrying some sand on his tractor on the basis of fabricated challan. It has been submitted that the petitioner is a driver of the said tractor which belongs to different person. He is an

Patna High Court Cr.Misc. No.38956 of 2018 (3) dt.25-07-2018 illiterate person having no knowledge about the challan. The petitioner is in custody since 16.03.2018 having clean antecedent and so he deserves bail.

The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Sri P.K. Malviya, J.M. 1st Class at Danapur, Patna in connection with Rani Talab P.S. Case No.59 of 2018. (Sanjay Kumar, J) Harish/- U
