2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 109(1) and 3(5) of the B.N.S. and Section 27 of the Arms Act.

3. The prosecution case in brief, is that on the alleged date and time of occurrence, the name accused persons came to the shop of one Pappu Yadav. All of a sudden, this petitioner along with other co-accused persons came there and accused Sunil Rai fired with pistol on the informant.

4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. Specific accusation of firing is against the co-accused Sunil Rai. So far as this petitioner is concerned, there is no specific overt

5. Learned counsel for the State opposed the bail petition.

6. Considering the aforesaid facts, no specific accusation against the petitioner and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 439 of 2025, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023.
