Petitioner prays for bail in connection with Nayagaon P.S.Case No. 55 of 2016 registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code, including 27 of the Arms Act.
Allegation against the petitioner is of firing on the informant and causing injuries to him.
Submission of learned counsel for the petitioner is that no firearm injury was found on the person of informant and petitioner is in custody since 21.6.2018 and so far other cases are concerned, he is on bail in all the cases.
Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.47136 of 2018 (2) dt.20-09-2018 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.
However, once charges have been framed in this case and trial commenced, petitioner shall be released on bail by learned trial court to its own satisfaction.
With the above observation, this application is disposed of.
