2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 379 of the Indian Penal Code and Section 67 of the I.T. Act.

3. As per prosecution case, the petitioner in connivance with other accused persons is alleged to have been indulged in hatching conspiracy to cheat the informant and withdraw money from his account by ATM.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted vide para 10, 14 & 15 of the petition that the petitioner is co-villager

Patna High Court CR. MISC. No.72296 of 2023( 3) dt.18-12-2023 2/2 of the informant and there is inimical term with them due to which the informant dragged the name of the petitioner in this case. During course of investigation, no any documentary proof has come against the petitioner in respect of cheating or withdrawing money from the account of the informant. The petitioner has got no criminal antecedent and is languishing in judicial custody since 14.7.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Manjhauliya P.S. Case No. 593 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, West Champaran at Bettiah.
