JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-03-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 379/307 and other ancillary sections of the Indian Penal Code.

Prosecution case is that all the FIR named accused persons including this petitioner assaulted mother of the informant and also snatched her Mangalsutra.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is case and counter case. In fact due to petty dispute, a free fight took place between either sides in which both parties sustained injuries. However, no specific overt act has been alleged against the petitioner. He has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender

Patna High Court CR. MISC. No.72818 of 2022(3) dt.14-03-2023 2/2 within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in Ghosi Police Station Case No. 262 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
