The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 406, 420, 120(B) of the Indian Penal Code.
The F.I.R. instituted on the basis of a written application by the Area Manager, L& T Financial Services, Motihari, alleging fraudulent withdrawl or embezzlement of an amount to the tune of Rs. 4,78,228/-.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.72621 of 2023(3) dt.31-01-2024 2/3 petitioner that the petitioner is innocent and he has falsely been implicated in the present case. The petitioner was working as field officer and his duty to collect the installment amount of loan from the customers and to deposit in the company. He has no concern with the process of sanction of the loan amount. He has no role in making any forged document and he has not withdrew any amount rather it is evident from the F.I.R. that co-accused Omprakash and Ravikant Kumar have made forged KYC, Aadhar Car and other documents. Moreover, the petitioner is languishing in judicial custody since 23.08.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Similarly situated co-accused Rahul Kumar has been granted bail vide order dated 02.12.2023, passed in Cr. Misc. No. 74905 of 2023 by the co-ordinate Bench of this Court.
Learned APP appearing for the State has vehemently opposed the prayer for Bail.

No.72621 of 2023(3) dt.31-01-2024 3/3 Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Sugauli P.S. Case No. 503 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari.
