The petitioner seeks bail in connection with Barauni (Chakia) P.S. Case No.125 of 2019 registered under Sections 394, 397, 307 and 326/34 of the Indian Penal Code and Sections 25(1-B)a, 26, 27, 28 and 35 of the Arms Act, pending in the court of the Chief Judicial Magistrate, Begusarai. The accusation is that the informant Santosh Sah was going with the truck bearing Registration No.NL01AA6923 from Darbhanga to the house of the owner of the truck at Chitra Koilwari. In the way at Simariyaghat, the road was busy due to several vehicles passing through the bridge. When the informant stopped his truck, at that time, four unknown persons

Thereafter, two unknown persons pulled the informant from the truck and all, on the point of pistol, snatched the mobile phone and cash Rs.17000/- of the informant and started causing assault to him. On the alarm being raised by the informant, the driver of another truck came there, then they made firing at him, due to which he sustained injury. At that time, when the driver of another truck made attempt to snatch the pistol of one unknown person, then, in that course, one unknown person caused injury on his head through pistol. One unknown person caused assault to the informant through iron rod, due to which he sustained injury on his right leg.

On hearing the sound of firing, police party rushed there, then all the aforesaid four unknown persons started to flee away but, on chase, three unknown persons were apprehended, who disclosed their name as Sulin Kumar alias Langra (petitioner), Bipin Kumar and Bihari Mahto alias Nerhawa. They also disclosed the name of their another associate as Raja Mahto, who succeeded to flee away. On search, the petitioner was found in possession of one loaded country made pistol and cash Rs.1200/-.

Learned counsel appearing on behalf of the petitioner submits that the petitioner having no criminal

Having regard to the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected. However, the petitioner would be at liberty to renew his prayer for bail after six months.
