2. The petitioner seeks bail in connection with Kazi Mohammadpur P.S. Case No. 61 of 2025 registered for the offence under Sections 80(2), 3(5) of the BNS.

3. As per the prosecution case, the petitioner, who is the husband of the deceased, is said to have killed his wife.

4. The petitioner is in custody since 1.3.2025.

5. Learned counsel for the petitioner submits that though the FIR was registered under Section 80(2) of the BNS but the charge-sheet has been submitted under Section 108 of the BNS. He further submits that the deceased has committed suicide and this fact has come in the case diary which is

Patna High Court CR. MISC. No.68091 of 2025(9) dt.09-04-2026 2/3 apparent from the description of the place of occurrence. The dead body was also taken out after breaking open the door of the room in which the body was found hanging. He also submits that the the trial is progressing.

6. Learned APP for the State has opposed the application of the petitioner.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below in connection with Kazi Mohammadpur P.S. Case No. 61 of 2025.

9. As a condition of this order, the petitioner, after being released on bail, is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

10. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at
