The petitioner has been in custody since 17.04.2018 in connection with Sarairanjan P.S. Case No. 39 of 2018 which was initially registered for the offences punishable under Sections 382/458/34 of the Indian Penal Code but subsequently the said provision was rectified vide order dated 27.04.2018 and the same was registered under Section 395/397/412 of the Indian Penal Code.
Learned counsel for the petitioner submits that there was theft in the temple and after overpowering the constables on duty, took away the idols from the temple. It has been submitted by learned counsel for the petitioner that on the basis of the confessional statement made before the police by a co-accused
Patna High Court Cr.Misc. No.45389 of 2018 (2) dt.09-08-2018 2/2 Shahnawaz @ Nehal, the petitioner has been implicated in connection with the present case though he is not named in the First Information Report and has also not been put on the T.I. Parade and no recovery has been made from the possession of the petitioner.
In view of the aforementioned facts and circumstances and only because the petitioner name has surfaced in the confessional statement of the co-accused Shahnawaz @ Nehal who has since been extended the privilege of bail in Cr. Misc. No. 45579 of 2018 vide order dated 30.07.2018, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Samastipur in connection with Sarairanjan P.S. Case No. 39 of 2018.
