Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366A, 372 of the Indian Penal Code.

According to FIR, the married daughter of the informant was kidnapped by the petitioner and co-accusedTapeshwar Rai. Submission is that victim in her statement under Section 164 Cr.P.C. though alleged kidnapping by the petitioner and Tapeshwar Rai. However, she is specific that she has already married with Pintu Rai with whom she had love affair. First husband of the victim is Bijay Rai. Considering the aforesaid material, the

Patna High Court Cr.Misc. No.47189 of 2018 (2) dt.10-08-2018 2/2 learned court below has granted bail to co-accusedTapeshwar Rai. Finding substance in the aforesaid submission, I am of the view that the petitioner deserves bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dumra Police Station Case No.375 of 2014, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
