2. With the consent of both the parties, this writ application is being disposed of at the present stage itself.

3. The petitioner in the present writ application has prayed for the grant of following reliefs:- i) To direct the Respondent authorities to pay relief grant of Rs.4,00,000/- to the petitioner in the light of notification issued by the petitioner containing Memo No. 4063 dt 8-9-15 whereby and whereunder the Govt has taken decision that in case of harness of employed teacher Rs.4,00,000/- would dependents.

(ii) To direct the respondent No. 6,7 to comply its order dt 24-03-2017 containing in Memo No. 326 issued by the Director Primary Education, Government of Bihar, Patna (Respondent No.2) whereby and whereunder the respondent No.3 directed the concerned District Education Officers and District Programme Officers to pay the Reliefs granted to the dependents of employed teacher at the earliest from any head. (Annexure-3) (iii) Any other relief/reliefs for which the petitioner is found entitled to and the Hon'ble court deems fit and proper.

After advancing some argument, learned counsel for the petitioner submits that for the relief as claimed for in the present writ application, the petitioner has already filed representation dated 01.11.2017 (Annexure-2) before the Block Education Officer, Phulwari Sarif, Patna, which as per the petitioner continues to be pending till date. He, therefore, submits that the petitioner would be satisfied, if an appropriate direction could be issued to the Block Education Officer, Phulwari Sarif, Patna, to dispose of the pending representation of the petitioner within a fixed time frame after giving an opportunity of hearing to the petitioner.

5. To this prayer being made by the learned counsel for the petitioner, the learned counsel for the Respondent-State

Patna High Court CWJC No.18825 of 2017(4) dt.18-12-2025 3/3 does not have any objection.

Considering the limited nature of prayer being made by the learned counsel for the petitioner, this writ application is disposed of directing the Block Education Officer, Phulwari Sarif, Patna to dispose of the pending representation of the petitioner, after giving an opportunity of hearing to the petitioner within a period of six months from the date of receipt/production of a copy of this order. Needless to emphasize that the final order which shall be passed by the Block Education Officer, Phulwari Sarif, Patna should be a reasoned and speaking order. It is made clear that in case the petitioner is found entitled to the relief as claimed by the petitioner, the same shall be extended to the petitioner within a further period of six months from the date of passing of the final order.

7. With the aforesaid observation and directions, the present writ application is disposed of. All pending Interlocutory Applications, if any, will be deemed to have been disposed of. (Alok Kumar Sinha, J) Gaurav Sinha/- U
