The petitioner is in custody in connection with Barauni (Chakia) P.S.Case No.191 of 2017 registered for an offence under Sections 302 and 201/34 of the IPC.

The case has been registered by the Dafadar when a dead body was recovered in a gunny bag.

It has been submitted that the petitioner is father of the deceased. The daughter of this petitioner had matrimonial dispute with her husband for which his daughter (deceased) had filed a Complaint Case No.1856 of 2016. The husband had called his daughter over mobile for settlement of dispute. The son-in-law of petitioner in collusion with police party, got a confessional statement recorded only to escape from the above crime. As per

Patna High Court Cr.Misc. No.63277 of 2017 (2) dt.11-01-2018 2/2 confession even if accepted, at best, an offence under Section 201/34 of the IPC is made out. The petitioner is in custody since 29.05.2017.

Learned APP opposed the submissions.

Considering the facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Begusarai in connection with Barauni (Chakia) P.S.Case No.191 of 2017.
