JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 20-03-2023 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners are seeking regular bail in connection with Jamui P.S. Case No. 466 of 2022 registered for offence punishable under sections 399, 402, 120(B)/34 of the Indian Penal Code and 25 (1-b)a, 26 and 35 of the Arms Act.

No.69849 of 2022(2) dt.20-03-2023 2/3 As per allegation, some miscreants were planning to commit serious type of offence. the petitioner Ranveer Kumar Mandal @ Pappu Mandal was arrested with a country-made pistol and one live cartridge. The petitioner Rocky Thakur @ Roki Thakur was arrested with one live cartridge. The learned counsel for the petitioners has submitted that the petitioners are innocent and they have been languishing in custody for six months. The petitioner Rocky Thakur @ Roki Thakur has no criminal antecedent, whereas there is one case against the petitioner Ranveer Kumar Mandal @ Pappu Mandal, but it is not of similar nature.

Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 466 of 2022, subject to the following conditions:- (i) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.

(ii) If the petitioners are found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below

(iii) After commencement of the trial, the petitioners shall remain present physically on each and every date fixed at the trial, and if they fail to appear without assigning any reason or unavoidable circumstances on two consecutive dates, the learned court below shall be at liberty to cancel their bail bonds.
