2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 379 and 356 of the Indian Penal Code.

3. According to the case of prosecution, one miscreant snatched Rs. 26040/- and some documents along with mobile phone of the informant. During investigation, certain papers were recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He is not named in FIR rather his name has come during the course of investigation. It is further submitted by learned counsel for the petitioner that the

Patna High Court CR. MISC. No.72159 of 2024(2) dt.07-10-2024 2/2 seizure list was prepared on 07.07.2024 whereas it was made seen to the Court on 03.07.2024. Petitioner has criminal antecedent. It has further been submitted that he has been remanded in those cases being apprehended in this case. Since, the looted cash has not been recovered from his conscious possession, the seizure list appears doubtful. Moreover, the petitioner is languishing in judicial custody since 08.07.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Deoriya P.S. Case No. 144 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-5th, Muzaffarpur. (Ashok Kumar Pandey, J) Shubham/- U T
