The petitioner is apprehending his arrest in connection with Kako P.S. Case No. 105 of 2016 for the offence registered under Sections 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the present petitioner is not named in the FIR but subsequently, during the course of investigation one accused Sachin Kumar was arrested and in his confessional statement made before the police the name of the petitioner has surfaced. It is further submitted that nothing was recovered from the possession of the petitioner and he has falsely been implicated in the instant case. Considering the aforementioned facts and circumstances, let the petitioner, above named, in the event of

No.71623 of 2019(4) dt.26-11-2019 2/2 his arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Kako P.S. Case No. 105 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
