JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-03-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 147,149,341,323,353/379 of the Indian Penal Code. Prosecution case is that while the chaukidar tried to inspect six sand loaded trucks, petitioner and other accused persons abused him and fled away from the place of occurrence. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion of the local chaukidar. He submits that the petitioner was never indulged in illegal trade of sand and as a matter of fact GPS data of his truck also reflects that the petitioner was not present on the spot at the relevant time.Petitioner has got no criminal antecedent.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in Koransarai Police Station Case No. 112 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
