The petitioner is languishing in custody since 25.8.2019 in a case registered for the offences punishable under Sections 272 and 273 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is that 25.500 litres Nepali liquor was recovered from the motorcycle of the petitioner. It is submitted by learned counsel for the petitioner that petitioner is accused in one other case apart from the present one and he is in custody since two months.

Learned APP submits that recovery has been made from the possession of the petitioner.

Considering the nature of recovery and the period under custody, let the petitioner above named be released on

Patna High Court CR. MISC. No.63278 of 2019(2) dt.25-10-2019 2/2 bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge -II-cum-Special Judge, Excise Act, Sitamarhi, in connection with Parihar P.S.
