JUSTICE ARUN KUMAR ORAL ORDER 06-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 6.3.2018 seeks bail in Imamganj PS Case No. 18 of 2018 registered under Sections 364, 302, 120(B) and 201/34 of the IPC.
The allegation in brief is that the dead bodies of informant's brother and his wife were found from nearby forest area and suspicion is raised against all the accused persons of killing both of them because earlier they had leveled accusation of practicing witch craft against them.
Learned Counsel for the petitioner submits that except suspicion raised there is no other material against him, the petitioner hs no criminal antecedent and similarly situated other accused Anuj Kumar was also admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 36049 of 2018.
Having considered the said facts and circumstances, the petitioner, namely, Upendra Das is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Sherghati in connection with Imamganj PS Case No. 18 of 2018.
