====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-01-2025 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 323, 324, 379, 354/504 and 34 of the Indian Penal Code.

3. As per the prosecution case, petitioner and other accused persons, in drunken condition, came to the informant and told him to compromise the case filed by him earlier. On protest, informant was assaulted by this petitioner and other accused persons and when his wife intervened in rescue, she too was assaulted by them. On information, the police came and took the informant to Banka Sadar hospital for his treatment and, thereafter, this petitioner and other accused persons committed loot-paat in the house of informant. During the loot, accused persons took out a bicycle, an iron-made door and cash of Rs. 5,000/- and also damaged the household items kept in the

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to old enmity. Doctor has found simple injury. No incriminating article has been recovered from the conscious possession of the petitioner. There is general and omnibus allegation against this petitioner and no specific overt act has been alleged against him. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Banka Police Station Case No. 04/2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
