JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-10-2025 Heard Mr. Rohit Kumar, learned counsel appearing on behalf of the petitioner and Mr. Umeshanand Pandit, learned APP appearing on behalf of the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 308(3), 308(4) and 351(2) of the B.N.S. and Sections 16, 17, 18, 19 and 20 of the U.A.P. Act.
3. As per prosecution case, informant, namely Michael Mula, alleged that for the last few days, repeated threat calls have been made on his mobile phone from mobile numbers 6281893952 and 8797045198, demanding extortion. The caller identified himself as a member of the banned extremist organization CPI (Maoist)/Naxal group. It is further alleged that

No.70125 of 2025(2) dt.08-10-2025 2/3 two years ago also the informant was threatened on two occasions and a demand of Rs. 3,00,000/- was made which he had to pay under compulsion and this time, the caller has demanded Rs. 8,00,000/- as extortion money and is repeatedly threatening to kill the informant in case of non-payment.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R. and he is a young boy aged about 18 years and is a student. The mobile numbers which are allegedly used in the crime does not belong to this petitioner. During course of investigation it has come that the alleged mobile numbers are registered in the name of one Ajay Prasad, son of Saryug Mahto and the SIMs were purchased from one Pawan Hans. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Jamui in connection with Charkapatthar P.S. Case No. 5 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S..
