Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 2.8.2017 passed in Cr. Misc. No.33859 of 2017 and allegation against this petitioner is that he had assaulted by fists and slaps and the dead body was recovered on next day.
Submission of the learned counsel for the petitioner is that the petitioner is in custody for about 16 months and up till now the trial has not been concluded in spite of direction of this Court to conclude it as soon as possible.
Heard learned A.P.P. also.
On perusal of the impugned order, it appears that
Patna High Court Cr.Misc. No.49474 of 2018 (2) dt.05-09-2018 2/2 four witnesses have been examined in this case. In such view of the matter, I am not inclined to grain bail to the petitioner however the learned trial court is directed to expedite the trial and try to conclude it within a reasonable period and if possible conduct it on regular basis without giving any unnecessary adjournment to the parties.
With the aforesaid observation, this application is dismissed.
