JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-05-2018 Heard Mr. Durga Nand Jha, learned counsel for the petitioner and learned AC to AAG-12 for the respondent-State. The present writ application has been filed for quashing the order dated 04.09.2015, passed by S.D.M., Darbhanga in MR Case No. 1866/2015, as contained in Annexure-1, whereby the proceeding under Section 144 Cr. P.C.
Patna High Court CWJC No.18852 of 2017(2) dt.01-05-2018 2/2 has been dropped. Further prayer has been made for getting the encroachment removed from the raiyati land of the petitioner, appertaining to Khata No. 202, Plot Nos. 540, 542, 546 and 551, situated in Mauza Thengaha, situated at Devna Tola Jayantipur, Circle Tardih, District Darbhanga, which has been encroached upon by private respondent nos. 6 to 16.
Learned counsel for the petitioner seeks permission to withdraw the present writ application to avail remedy before appropriate forum for redressal of his grievances. Permission is accorded.
