JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-01-2023 Heard learned counsel for the petitioner and the State. Earlier prayer for bail of the petitioner was refused by this Court vide order dated 26.4.2022.

It is submitted by learned counsel for the petitioner that similarly situated co-accused Chandan Gond has already been allowed bail by this Court vide order passed in Cr.Misc.No. 18926/2022 and the petitioner is in custody since 13.9.2021and there is no likelihood of conclusion of the trial in near future.

Considering the progress of the trial and period of custody of the petitioner, let the petitioner as named above be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate V, Bhojpur at Ara in Bihiya Police Station Case No. 324 of 2021.
