JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with Samastipur Rail P.S. Case No 37 of 2017 registered for offences alleged under Sections 414, 401 of the Indian Penal Code.

Learned counsel for the petitioner submits that the present petitioner has been arrested alleging that he was one of the persons, who had assembled on the platform and was involved in planning to commit an offence. It is stated that in course of search, only a mobile phone, which belongs to the petitioner, has been recovered. The petitioner has no criminal antecedent. It is further submitted that co-accused Shubham Kumar and Abhishek Kumar

Patna High Court Cr.Misc. No.63760 of 2017 (2) dt.11-01-2018 2/2 have been granted regular bail by a co-ordinate Bench of this Court in Cri. Misc. No. 42850 of 2017.

Learned APP opposed the prayer for bail.

Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rail, Samastipur in connection with Samastipur Rail P.S. Case No. 37 of 0217 subject to the conditions U/S 437(3) Cr.P.C.
