The petitioner seeks bail in connection with Laukahi P.S. Case No. 87 of 2025 instituted for the offence under Sections 317(5), 317(4) & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case is that during routine vehicle checking, police received information about stolen motorcycles and apprehended the co-accused Hind Kumar Yadav, who confessed that he and Manish Kumar Mandal (the petitioner) were involved in theft and sale of motorcycles. Acting on this, police also caught Manish Kumar Mandal (petitioner) and recovered a stolen red Apache motorcycle from his possession.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 06-05-2025. Petitioner bears two criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case due to personal enmity and village politics. He further submits that none of the motorcycles were ever recovered from the conscious possession of the petitioner or from within his residential premises. Petitioner has got no concern with the alleged occurrence. There is no compliance of Section 103 of the B.N.S.S., 2023. It is further submitted that the co-accused Hind Kumar Yadav has already been granted bail by this Court vide order dated 17.09.2025 passed in Cr. Misc. No. 65809 of 2025.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, manner of petitioner's implication as also the prayer for bail being based on parity, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing

Patna High Court CR. MISC. No.68974 of 2025(2) dt.07-10-2025 3/3 bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Laukahi P.S. Case No. 87 of 2025.
