2. The petitioner has preferred this application for grant of regular bail in connection with Barahiya P.S. Case No. 78 of 2024 dated 30.03.2024 registered for the offences punishable under Sections 341, 323, 379, 307, 504, 506 and read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioner is alleged to have fired on the son of the informant while he was coming by tractor loaded with husk. It is further alleged that the petitioner has also made another firing on the younger son of the
Patna High Court CR. MISC. No.72978 of 2024(4) dt.25-02-2025 2/3 informant and threatened them of dire consequences.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. As per injury report of the injured which shows that only one injury has been found by the doctor in right elbow which is on non-vital part of the body. The petitioner has no concern with the alleged occurrence. The petitioner has six criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 23.05.2024.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Lakhisarai in connection with Barahiya P.S. Case No. 78 of 2024, with the condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable
Patna High Court CR. MISC. No.72978 of 2024(4) dt.25-02-2025 3/3 cause, the bail bonds of the petitioner are liable to be cancelled.
