JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-11-2019 This is an application for grant of anticipatory bail in connection with Piparia P.S. Case No. 60 of 2019, disclosing offences under Sections 447, 341, 323, 324, 307, 379, 34 of IPC.

In view of the submission made by learned counsel

Patna High Court CR. MISC. No.69217 of 2019(2) dt.14-11-2019 2/3 for the petitioners that petitioner no.4 has been arrested during the pendency of this application. As such, this application stands dismissed as withdrawn against the petitioner no.4. So far as petitioner no.1 is concerned, he is said to have assaulted by Barchi on the brother of the informant. So far as petitioner no.5 is concerned, there is allegation of assault by rod to the informant and other petitioners are also named in the F.I.R and there is general allegation against other petitioners also of assault.

Submission of the learned counsel for the petitioners is that there is case and counter case between the parties. Except petitioners no.1 and 5 no specific allegation has been attributed against the petitioners.

Heard learned A.P.P. also.

Having heard both sides, considering the above submissions, let except the petitioner no.4, the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M. Lakhisarai, in connection with Piparia P. S. Case No. 60 of 2019, subject to the condition laid down under
