The petitioner seeks bail in anticipation of her arrest in connection with Jamui P.S. Case No. 323 of 2015 (arising out of Complaint Case No. 1716C of 2014), dated 02.12.2015, instituted for the offences under Sections 120(B), 420, 467, 468, 471, 323 and 504 of the Indian Penal Code.

The accusation against the petitioner is that she

Patna High Court CR. MISC. No.75693 of 2019(5) dt.06-12-2021 2/3 has purchased the land from the vendors even while knowing that the land did not belong to them.

It has been submitted on behalf of the petitioner that the accusation was investigated but final report false was submitted against all the accused persons including the petitioner.

Differing with the police report, cognizance has been taken against the petitioner under Sections 120(B), 420, 467, 468, 471, 323 and 504 of the I.P.C. It has further been submitted on behalf of the petitioner that the vendors are the co-sharers and agnates of the informant and only because the respective shares in the family property was not correctly demarcated, no offence under any one of the sections in which cognizance has been taken can at all be said to have been made out, more particularly against the petitioner.

The vendors of the property have been granted anticipatory bail by a Bench of this Court vide order dated 24.10.2019 passed in Cr. Misc. No. 65105 of 2019. Regard being had to the facts afore-stated, the

No.75693 of 2019(5) dt.06-12-2021 3/3 petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of three weeks, is directed to be released on bail on her furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 323 of 2015 (arising out of Complaint Case No. 1716C of 2014), subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
