Petitioner seeks bail in a case registered for the offences punishable under Sections 399,402,414 of the Indian Penal Code.
The allegation is that the police recovered huge quantity of arms and ammunitions from the cattle shed of co-accused-Umesh Kumar Yadav. The petitioner and others were apprehended thereat. From possession of the petitioner, a country made loaded pistol was recovered alongwith cartridges.
Submission is that similarly situated coaccused Ajit Singh @ Ajit Kumar Singh has been granted bail by a Coordinate Bench of this Court in Cr.Misc.No.24391 of
Patna High Court Cr.Misc. No.47963 of 2018 (2) dt.20-08-2018 2/2 2018 considering the fact that for recovery of firearm a separate case bearing Rivilganj P.S.Case No.17 of 2018 was registered. Petitioner is in custody since 17.01.2018. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rivilganj Police Station Case No.16 of 2018, G.R.No.423 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
