The petitioner apprehends his arrest in connection with Simri P.S. Case No. 114 of 2018 registered under Sections 341, 323, 447, 307, 379 and 504/34 of the Indian Penal Code. The accusation is that petitioner gave Dav blow at the head of informant, Dinanath Rai and his maternal granddaughter, Anita Kumari. At that time, Ram Sadav Rai snatched gold chain from the neck of his maternal granddaughter.

Learned counsel for the petitioner submits that informant and the petitioner are Gotiya and due to some dispute, occurrence took place, in which, informant and his maternal

Patna High Court CR. MISC. No.63182 of 2019(2) dt.21-10-2019 2/2 granddaughter received slit injury but with ulterior motive, the present case has been lodged with false allegation. Moreover, the injuries as found on the person of informant and his maternal granddaughter are simple in nature.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Buxar, in connection with Simri P.S. Case No. 114 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
