2. The petitioner seeks bail in connection with Sessions Trial No. 219 of 2025 arising out of G. B. Nagar P.S. Case No. 312 of 2024 instituted for the offence under Section 302 of the Indian Penal Code.
3. As per prosecution case, on the pretext of celebrating birthday petitioner took the son of the informant and murdered him by cutting his neck.
4. The petitioner has renewed his prayer for grant of regular bail which was earlier rejected by this Court on merit vide order dated 20.11.2024 passed in Cr. Misc. No. 70524 of 2024.

5. Learned counsel for the petitioner submits that the petitioner is in custody since 21.06.2024. It is further submitted that the chargesheet has been submitted against the petitioner and, thereafter, the cognizance has also been taken by the learned court below and the case was committed to the Court of Sessions and, thereafter, charges were framed against the petitioner but, on behalf of the prosecution, not a single witness has been examined till today and, as such, there is no likelihood of conclusion of the trial in near future.
6. In compliance to the order of this Court, the learned court below has sent report dated 07.10.2025 regarding present stage of trial.

From perusal of the aforesaid report dated 07.10.2025, it appears that the charge has been framed on 02.06.2025 and the summons have been issued on 12.06.2025 for the appearance of the prosecution witnesses and the bailable warrants have also been issued on 05.08.2025. The case is running for prosecution evidence and the next date is fixed on 09.10.2025 for examination of the prosecution witnesses.
8. This Court finds that there is no new ground to reconsider the bail application of the petitioner and the trial is already in progress.

9. In that view of the matter, the present application is again rejected with a direction to the court below to expedite the trial and conclude the same expeditiously preferably within a period of five months from today.
10. If the trial is not concluded within the aforesaid period of five months, the petitioner will be at liberty to renew his prayer for bail before the learned court below. (Rudra Prakash Mishra, J) rishi/- U T
