The petitioner has filed the instant application for grant of regular bail in connection with Udawant Nagar P.S. Case No. 447 of 2022 registered under section 395 of the Indian Penal Code.

Allegation against the petitioner along with several coaccused persons is that they snatched the bag of the informant containing Rs. 30,000/- along with some medicine and snatched the key of the informant's motorcycle. Further, one accused person on the point of pistol, was trying to snatch his mobile phone but in the meantime, on seeing the police they fled from there but after chase this petitioner was apprehended by the police.

He has falsely been implicated in this case merely on suspicion. It is further submitted that nothing looted articles have been recovered from his conscious possession. There is no eye witness of the alleged occurrence. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent and he is languishing in judicial custody since 23.09.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Udawant Nagar P.S. Case No. 447 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions JudgeXIII Bhojpur at Ara.
