The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 413, 414/34 of the Indian Penal Code.

As per allegation in the FIR, three accused persons including the petitioner were apprehended with two stolen motorcycles. On search mobile phones were recovered from their possession.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He was sitting as a pillion rider on the motorcycle which was being drived by co-accused Raju Kumar. He has no concern with the alleged stolen motorcycle. This case is triable by judicial

Patna High Court CR. MISC. No.68912 of 2022(3) dt.12-07-2023 2/2 magistrate. Nothing has been recovered from his conscious possession. Petitioner is languishing in judicial custody since 4.09.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 3rd ACJM, Motihari, East Champaran in connection with Kalyanpur P.S. Case No. 242 of 2022.
