The petitioner seeks bail in Ahiyapur P. S. Case No. 443 of 2018 instituted for the offence under Section(s) 376 of the Indian Penal Code and Section 6/10 of Pocso Act. It is alleged in the written report that while the informant had gone in the marriage in the neighbourhood this petitioner took the niece of the informant in Banswari and committed illegal act with her on the point of chaku. The victim girl has given her statement U/s 164 Cr.P.C. which is available in the case diary, wherein, she has levelled specific allegation against this petitioner. In her statement recorded U/s 164 Cr.P.C. she has stated her age to be 15 years whereas the Court has assessed her age to be 14 years.
Patna High Court Cr.Misc. No.51556 of 2018(3) dt.08-10-2018 2/2 The medical report of the victim girl is available in the case diary, wherein, the doctor has found slight bleeding present, vaginal abrasion was also found.
In such circumstances, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected.
Petitioner may renew prayer for bail after six months if no substantial progress is made in the trial. (Sanjay Priya, J) shyambihari/- U T
