2. Petitioners seek regular bail in case registered for offence under Sections 103 (1) , 61 ( 2 ) and 3 (5) of BNS. 3 . As per prosecution case, informant namely, Virendra Singh alleged that on 18.05.2025, when informant went to his home, he saw that accused persons were fleeing along with two others and thereafter, informant discovered his nephew lying grievously injured, with blood profusely oozing from his body and thereafter, on being taken to hospital, doctor declared him dead.
4. Learned counsel for the petitioners submitted that
Patna High Court CR. MISC. No.67656 of 2025(3) dt.25-11-2025 2/3 from bare perusal of F.I.R. it is apparent that these petitioner were only seen running away from the house of informant. Informant is not an eye witness to the alleged occurrence . None of the witnesses have claimed to have seen this petitioner committing the alleged offence . These petitioners have falsely been implicated in this case because they had land dispute with the informant. During course of investigation , it has come that there was some quarrel between the deceased and his wife and due to that deceased Eklavaya Kumar committed suicide by hanging. Postmortem report goes to show that cause of death is asphyxia leading to CR failure as a result of hanging and no internal or external injury has been found on the body of the deceased. Petitioners claim clean antecedent and is in custody since 20.05.2025 .
5 . Learned A.P.P. for the State vehemently opposed the bail petition.

Considering the aforesaid facts, period of custody , clean antecedent of these petitioners and circumstances of the case , let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM - 1 Sitamarhi in connection with Riga PS Case
