2. The petitioner has prayed for bail in connection with Mathurapur P.S. Case No. 43 of 2025 registered for the offence punishable under Sections 80(2) and 3(5) of B.N.S. read with Section 3⁄4 of Dowry Prohibition Act.

3. The case of the prosecution, in short, is that the daughter of the informant, namely, Chandani Kumari (deceased) was married to one Suraj Kumar. She was subjected to cruelty on account of non-fulfillment of dowry demand. On 08.05.2025 the deceased was narrating to the informant that she has been assaulted by her husband and was ousting her from the house, failing which she will be killed. On 09.05.2025, the informant came to know that his daughter has been killed by the in-laws.

4. Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.68276 of 2025(2) dt.24-09-2025 2/2 has submitted that petitioner is innocent and has committed no offence. Petitioner is father-in-law and he has been falsely implicated in this case. The main thrust of allegation is against the husband. It has also been submitted that after the occurrence the informant was informed, postmortem was conducted and from perusal of the postmortem report, it will transpire that one ligature mark was found around the neck and the cause of death is due to asphyxia by hanging. It has also been submitted that the husband is in custody. Petitioner is languishing in judicial custody since 09.05.2025.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned concerned Judicial Magistrate 1st Class, Samastipur in connection with Mathurapur P.S. Case No. 43 of 2025.
