The petitioner is apprehending his arrest in connection with Manjhagarh P.S.Case No.186/19 registered for offences punishable under Section 392 of the Indian Penal Code. As per FIR, four miscreants riding on a motorcycle surrounded the informant and assaulted him and further snatched Rs.3,500/- and mobile. Petitioner is not named in the FIR and later on one co-accused was arrested and he confessed his guilt and disclosed the name of the petitioner. Submission of the learned counsel for the petitioner is that except the confessional statement there is nothing against him and there is no recovery.
Heard learned A.P.P. , who has opposed the prayer for
Patna High Court CR. MISC. No.64738 of 2019(2) dt.16-10-2019 2/2 bail on the ground that there is confessional statement and further custodial interrogation is required in view of the allegation. .
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner. With the aforesaid direction, this application is dismissed.
