ANJANA MISHRA ORAL ORDER 21-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 03.07.2018 in connection with Nawada Town P.S. Case No.196 of 2017 registered for the offence under Sections 147, 148, 149, 341, 323, 307, 353, 188, 283, 337, 427, 435 and 153(a) of the Indian Penal Code.
Learned counsel for the petitioner submits that certain tensions arose between the two communities over their raising of slogan of "Jai Sri Ram" and in response thereto, other community pelted stones, which resulted in some altercation and as a result thereof, some shops were damaged. No.49710 of 2018 (2) dt.21-08-2018 2/2 the petitioner can be treated to be a member of the mob and other similarly situated persons have since been extended the privilege of bail in Cr.Misc. No.47265 of 2018 vide order dated 02.08.2018 and also in Cr.Misc. No.42802 of 2018 vide order dated 24.07.2018.
In view of the aforementioned facts circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No.196 of 2017.
